1. Introduction

Welcome to MyCode.Art. By accessing our website at mycode.art or using our custom code poster creation services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site or our services.

These Terms govern your access to and use of MyCode.Art's website, products, and services, including our custom code poster design and printing services.

2. Use License

Permission is granted to temporarily access and view the materials (information, software, products, and services) on MyCode.Art's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • Modify or copy the website materials
  • Use the website materials for any commercial purpose without authorization
  • Attempt to decompile or reverse engineer any software or tools contained on MyCode.Art
  • Remove any copyright or other proprietary notations from the materials
  • Transfer the materials to another person or "mirror" the materials on any other server

This license applies to the website and its content only. Once you purchase a poster, you own that physical product and may enjoy it personally. The MyCode.Art website design, branding, and tools are our intellectual property. Please don't reproduce your poster commercially or resell our designs.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by MyCode.Art at any time.

3. Products and Services

MyCode.Art offers custom code posters that allow you to create personalized artwork featuring your own code, with customizable options including:

  • Programming language syntax highlighting
  • Multiple color themes and design styles
  • Various poster sizes and formatting options
  • Custom text and typography choices

All products displayed on our website are subject to availability. We reserve the right to discontinue any product at any time. Prices for our products are subject to change without notice. We reserve the right to refuse any order placed with us.

By purchasing our products, you acknowledge and agree that:

  • Colors may vary slightly from what appears on your screen due to monitor calibration and printing processes
  • Dimensions may have slight variations due to the handcrafted nature of our products
  • Custom orders are final and cannot be returned unless there is a manufacturing defect or damage during shipping
  • Pre-made (non-custom) posters may be returned in accordance with our Shipping Policy
  • You are responsible for reviewing your custom design before finalizing your order

4. User-Submitted Content

When you create a custom poster using our services, you may submit code, text, or other content ("User Content") to be included in your poster design.

Your Intellectual Property Rights

You retain all ownership rights to your User Content. MyCode.Art does not claim ownership of any code, text, or other materials you submit through our customization tools.

License Grant

By submitting User Content, you grant MyCode.Art a limited, non-exclusive license to use, reproduce, and display your User Content solely for the purpose of creating, producing, and delivering your ordered poster. This license terminates once your order is fulfilled, except for record-keeping purposes required by law.

Your Responsibility

Please ensure you have the right to use any code or content you submit for your custom poster. We trust that you'll submit content that you're authorized to use and that doesn't contain any illegal or offensive material.

5. Payment Processing

All payments are processed securely through Stripe, our third-party payment processor. We do not store your complete credit card information on our servers.

By making a purchase, you agree to:

  • Provide accurate and complete payment information
  • Stripe's Terms of Service and Privacy Policy
  • Pay all charges at the prices in effect when you place your order

All prices are displayed in Euros (EUR). Depending on your location, your purchase may be subject to Value Added Tax (VAT) or other applicable taxes, which will be calculated and displayed at checkout. Payment must be received in full before we begin processing your order.

We reserve the right to refuse or cancel any order at any time for reasons including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

6. Shipping, Delivery, and Returns

All matters related to shipping, delivery times, tracking, returns, refunds, and exchanges are governed by our separate Shipping Policy. Please review our Shipping Policy carefully before placing an order.

Key points include:

  • We ship to select countries within the European Union and Europe
  • Shipping costs are calculated based on destination and poster size
  • Custom/personalized posters are final sale and cannot be returned
  • Damaged or defective items will be replaced or refunded regardless of customization

7. Accuracy of Information

We strive to ensure that all information on our website is accurate, complete, and current. However, we do not warrant that the product descriptions, prices, or other content available on the site is error-free. If we discover an error in the pricing or description of a product, we reserve the right to correct the error and charge the correct price or, if the error is substantial, cancel your order and provide a full refund.

You are responsible for reviewing your custom poster design preview before completing your purchase. Once you confirm your order, we will produce your poster according to the specifications you provided.

8. Intellectual Property

The MyCode.Art website and its original content, features, functionality, design, and branding are and will remain the exclusive property of MyCode.Art and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws of Portugal and international treaties.

Our trademarks, logos, and trade dress may not be used in connection with any product or service without the prior written consent of MyCode.Art.

This does not apply to User Content you submit for your custom posters. As stated in Section 4, you retain ownership of your submitted code and content.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall MyCode.Art, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

EU Consumer Rights: Nothing in these Terms shall affect your statutory rights as a consumer under applicable EU consumer protection laws. This limitation of liability does not apply to liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation.

10. Governing Law and Dispute Resolution

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.

Jurisdiction

Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts of Portugal.

EU Online Dispute Resolution

In accordance with EU Regulation 524/2013, European consumers may use the European Commission's Online Dispute Resolution (ODR) platform to resolve disputes. The ODR platform can be accessed at: https://ec.europa.eu/consumers/odr.

Informal Resolution

We are committed to resolving disputes amicably and efficiently. Before initiating any formal legal proceedings or dispute resolution process, we encourage you to contact us at support@mycode.art to seek an informal resolution. We will make every reasonable effort to resolve your concerns.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

We encourage you to review these Terms periodically for any changes. The "Last Updated" date at the top of this page indicates when these Terms were last revised.
